About These Terms
These Terms & Conditions apply to all equipment hire and services provided by EV-ENTZ.CO.UK LIMITED (Company number 06715306), trading as EV-ENTZ Music.
Our services include backline hire, orchestral percussion, stage management, production support, and crew services.
By placing a booking with us, you agree to be bound by these terms.
1. Definitions & Interpretation
EV-ENTZ means EV-ENTZ.CO.UK LIMITED (Company number 06715306), trading as EV-ENTZ Music, with registered office at Ev-Entz Music, Crawford Street, Newport, Wales, NP19 7AY.
Client/Hirer means the person, company, organisation, or entity booking equipment or services from EV-ENTZ.
Equipment means the equipment being hired to you as specified in the quotation/invoice.
Casualty Value means the market value that the Equipment would have had at the end of the Hire Period had it been returned to us in a good state of repair, commensurate with age.
Total Loss means the Equipment is stolen, lost, or damaged beyond economic repair.
Services means any service provided by EV-ENTZ including: equipment delivery and collection, installation and setup, operation, stage management, production support, crew services, and technical support.
Hire Period means the period from the earlier of (a) dispatch from our premises, or (b) delivery to your specified location, until equipment is returned to our premises and inspected by EV-ENTZ.
Business Day means Monday to Friday, excluding UK public holidays.
2. Contract Formation
2.1 Booking Methods
You may place hire orders with us by email (hire@ev-entz.co.uk), telephone (+44 (0)1633 250062), online enquiry form, written purchase order, signed contract, or in person at our premises.
2.2 When the Contract Becomes Binding
A legally binding contract is formed at whichever occurs first: (a) when EV-ENTZ confirms your booking in writing (by email or signed contract), OR (b) when equipment/services are dispatched or supplied to you.
2.3 Quotations & Availability
All quotations are valid for 14 days unless otherwise stated, subject to availability. We reserve the right to decline any order at our discretion.
3. Lease
We agree to lease the Equipment to you, and you agree to lease the Equipment from us, in accordance with these Terms and Conditions.
4. Pricing, Deposits & Payment Terms
4.1 Hire Charges
Hire charges will be as shown in your quotation/invoice, including equipment daily/weekly hire rates, delivery and collection charges, installation fees, crew services, and any special requirements.
4.2 Payment Terms
Business clients: Payment within 30 days of invoice date (or as specified). New clients or high-value bookings may require deposit or full prepayment before dispatch.
4.3 Accepted Payment Methods
We accept: Bank transfer (BACS - preferred), Credit/debit card (Visa, Mastercard - we do not accept American Express), Cash (for collection in person).
4.4 Late Payment
Late payments incur interest at 8% per annum above Bank of England base rate, plus £50 administration fee.
4.5 VAT for Overseas Clients
UK VAT applies to all equipment hire and services used within the UK, regardless of where the client is based, in accordance with HMRC 'use and enjoyment' rules. Overseas clients must pay UK VAT at 20% on equipment hired for use at UK events.
5. Liability, Limitations & Indemnity
5.1 Limitation of Liability
EV-ENTZ shall not be liable for:
- any indirect or consequential losses;
- Loss of profits;
- Loss of business opportunity;
- Loss of goodwill or reputation;
- Loss of anticipated savings;
- Loss of or damage to data;
- Any special, indirect, or consequential loss or damage.
5.2 Cap on Liability
Subject to clause 5.3, EV-ENTZ's total aggregate liability to the Client in respect of all claims arising out of or in connection with this contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to the total hire charges paid or payable under the affected booking.
This limitation applies separately to each booking/event.
5.3 Exceptions to Limitations
Nothing in these Terms limits or excludes EV-ENTZ's liability for:
- Death or personal injury caused by negligence;
- Fraud or fraudulent misrepresentation;
- Breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession);
- Breach of the terms implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession);
- Any other liability which cannot lawfully be limited or excluded.
5.4 Client Indemnity
You agree to indemnify and hold harmless EV-ENTZ against all claims, losses, damages, costs, and expenses (including legal fees) arising from: your use or misuse of hired equipment, injury to persons or damage to property caused by your use of equipment, your breach of these Terms, or third-party claims related to your use of equipment or services.
5.5 Consumer Rights
If you are a consumer, nothing in this clause 5 affects your statutory rights under the Consumer Rights Act 2015.
6. Insurance Requirements (Mandatory)
The Client is solely and entirely responsible for arranging and maintaining adequate insurance coverage for all hired equipment throughout the Hire Period.
6.1 Client Insurance Responsibility
You must arrange insurance that covers the full new-for-old replacement value of all hired equipment, including: theft, accidental damage, malicious damage, water damage, fire damage, transit coverage, and storage coverage.
6.2 EV-ENTZ Does Not Provide Insurance
EV-ENTZ does not provide insurance cover of any kind. The Client remains 100% responsible for loss or damage to equipment regardless of cause, except where directly caused by EV-ENTZ's proven negligence.
6.3 Proof of Insurance
EV-ENTZ reserves the right to request proof of adequate insurance before releasing equipment. If proof cannot be provided, we may delay service, cancel the booking, or refuse to release equipment.
7. Use of Equipment
7.1 Proper Use
You will use the Equipment in a good and careful manner and will comply with:
- all manufacturer's requirements and recommendations in respect of the Equipment; and
- all applicable law.
7.2 Intended Purpose
You will use the Equipment for the purpose it was designed and not for any other purpose.
7.3 No Modifications
You will not alter, modify or attach anything to the Equipment.
7.4 Maintenance and Repair
You will, at your own expense, keep the Equipment in good repair, appearance and condition, commensurate with the condition in which it was supplied to you and fair wear and tear.
7.5 Repairs by EV-ENTZ
If the Equipment is not in good repair, appearance and condition when it is returned to us, we may make such repairs as are necessary to put the Equipment in a state of good repair, appearance and condition, commensurate with the condition in which it was supplied to you and fair wear and tear. We will make such repairs within a reasonable period and shall provide you with written notice of the repairs and the associated costs. Upon receipt of such invoices, you will reimburse us for the actual costs of such repairs, and any lost income that we can, acting reasonably, demonstrate that we have lost due to the Equipment being unavailable for hire whilst being repaired.
7.6 Risk of Loss
To the extent permitted by law, you will be responsible for risk of loss, theft, damage or destruction to the Equipment whilst it is hired to you.
7.7 Total Loss - Casualty Value Payment
If the Equipment is stolen, lost, or damaged beyond economic repair, you will promptly pay to us the Casualty Value of the Equipment. Upon payment of the Casualty Value, this agreement shall cease in respect of that Equipment.
7.8 Ownership
The Equipment is and shall remain our property.
8. Delivery, Collection & Site Requirements
8.1 Delivery Area
We deliver to locations throughout the UK. All deliveries must be signed for by a person aged 18 or over.
8.2 Client Responsibilities
You must ensure safe vehicle access, parking, loading facilities, obtain all required venue permissions, and provide on-site contact during delivery/collection windows.
8.3 Waiting Time & Access Delays
Waiting time caused by venue access restrictions, lack of parking/loading facilities, or venue delays may be chargeable at £60 per hour.
8.4 Return Requirements
Unless otherwise agreed, all equipment must be returned by 12:00 noon on the return date, packed securely in original cases, clean and in good working condition, with all cables properly coiled.
Any parking fines, congestion charges, or penalty notices incurred during delivery or collection will be passed on to the Client in full, plus a £25 administration fee.
9. Crew, Stage Management & Production Services
9.1 Safe Working Conditions
Where EV-ENTZ provides crew or stage management, you must provide safe working conditions in compliance with Health & Safety legislation, adequate welfare facilities, and required PPE.
9.2 Venue-Imposed Costs
You are responsible for any third-party costs imposed by venues unless otherwise agreed in writing, including mandatory venue stewards, loading crew requirements, vehicle permits, power supply charges, and waste disposal fees.
10. Cancellations, Postponements & Amendments
10.1 Cancellation Requirements
All cancellations must be made in writing to hire@ev-entz.co.uk
10.2 Business Customers - Cancellation Charges
More than 4 days: Refund less costs incurred; 72-96 hours: 25%; 48-72 hours: 50%; 24-48 hours: 75%; Less than 24 hours: 100%
10.3 Consumer Customers - Cancellation Rights
If you are a consumer, you have the right to cancel within 7 days from the day after the contract is formed, or until hire commences (whichever is sooner).
11. Force Majeure (Events Beyond Our Control)
EV-ENTZ shall not be liable for delay or failure to perform due to events beyond our reasonable control, including: severe weather, vehicle breakdown despite reasonable maintenance, road closures, venue closures, government restrictions, pandemic, industrial action, supplier failures, power failures, acts of terrorism, or natural disasters.
If Force Majeure prevents performance for more than 7 days, either party may terminate the contract by written notice. Charges paid for services not yet provided will be refunded. Neither party shall be liable for consequential losses.
12. Contract Termination & Equipment Repossession
12.1 Termination by EV-ENTZ
We may terminate the contract immediately and repossess equipment if: you breach these Terms, payment is not made when due, you enter insolvency/administration, or equipment is being used unsafely.
12.2 Charges Upon Termination
Upon termination for breach, you remain liable for all hire charges up to repossession, damage/loss/cleaning charges, loss of hire income, and costs of repossession.
13. Data Protection & Privacy
EV-ENTZ processes personal data in accordance with the Data Protection Act 2018 and UK GDPR. We use your data to process and fulfil your booking, communicate with you, send invoices, maintain records, and comply with legal obligations.
We retain booking data for 7 years for accounting and legal purposes. You have the right to access, correct, request deletion, object to processing, and lodge a complaint with the Information Commissioner's Office.

14. Complaints & Dispute Resolution
If you have a complaint, please contact us at hire@ev-entz.co.uk or by post to EV-ENTZ Music, Crawford Street, Newport, Wales, NP19 7AY.
We aim to acknowledge complaints within 2 Business Days and provide a substantive response within 10 Business Days.
Both parties agree to attempt to resolve disputes in good faith through negotiation before commencing legal proceedings.
15. General Provisions
15.1 Entire Agreement
These Terms, together with your quotation/invoice and any written amendments, constitute the entire agreement between EV-ENTZ and the Client.
15.2 Variations
Any variation to these Terms must be agreed in writing and signed by both parties.
15.3 Severability
If any provision is found invalid, illegal, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force.
15.4 Assignment
You may not assign or transfer your rights or obligations without our prior written consent.
15.5 Notices
All notices must be in writing and may be served by email (deemed delivered when sent if during business hours), first class post (deemed delivered 2 Business Days after posting), or hand delivery (deemed delivered immediately).
15.6 Governing Law
These terms and conditions, and any non-contractual obligations arising out of them, shall be subject to the laws of England and Wales and the jurisdiction of the Courts of England and Wales.
